This Acceptable Use Policy (“Policy”) establishes the governing rules, operational guidelines, and ethical standards for accessing and utilizing the NewtekCM Management Team (NTM) website and digital platform (the “Platform”).

By accessing, registering for, or operating within the Platform, you expressly consent to strictly comply with this Policy. Failure to adhere to these terms may result in immediate suspension, account termination, and potential legal action.

1. Permitted Use

The Platform is engineered exclusively for lawful commercial activities related to real estate services, including property listing, promotion, and facilitating transactions. Users are strictly prohibited from utilizing the Platform for any operations that violate local, national, or international laws and regulations.

2. Prohibited Activities

To maintain the integrity and security of the Platform, you agree not to engage in, attempt to engage in, or assist others in any of the following activities:

Fraudulent Listings: Uploading, publishing, or distributing false, misleading, or deceptive property listings.
Objectionable Content: Posting materials that are illegal, defamatory, discriminatory, obscene, or threatening.
Unauthorized Access: Attempting to breach or bypass the security of other user accounts or internal NTM systems.
Financial Circumvention: Evading, altering, or attempting to circumvent Platform fees or mandatory commissions.
Automated Scraping: Deploying automated scripts, bots, spiders, or scrapers without explicit authorization.
System Disruption: Executing actions that impose an unreasonable load on the Platform’s infrastructure.

3. Intellectual Property & Content Rights

You affirm that all content, imagery, and documentation you upload to the Platform is either entirely owned by you or utilized with explicitly granted, legally binding authorization.

By submitting content to the Platform, you grant NTM a non-exclusive, royalty-free, worldwide license to utilize, display, and distribute your content for operational, promotional, and marketing purposes.

4. Agent Conduct & Legal Compliance

Real estate agents operating on the Platform are required to strictly adhere to all applicable laws, statutes, and ethical guidelines governing real estate practices in Cameroon.

Independent Standing: NTM does not supply agent licensing, professional training, or legal certifications.
Responsibility: Agents bear sole responsibility for securing and maintaining their required legal qualifications and professional credentials.

5. Commission Structure

As consideration for the utilization of the Platform’s infrastructure and marketplace, NTM Construction, Management & Services levies a mandatory operational fee on successful transactions.

For every property successfully sold or leased via connections made through the Platform, NTM shall receive 2% of the acting agent’s total commission.
This fee is absolute, mandatory, and non-negotiable.

6. Account Security & Privacy

Users hold total responsibility for safeguarding the confidentiality of their account credentials and login information. Any suspected breach of security or unauthorized account access must be reported to NTM administration immediately. All data processing and user information management are governed by the NTM Privacy Policy.

7. Violations, Enforcement, and Termination

NTM reserves the absolute right to monitor Platform usage and investigate any suspected violations of this Policy. In the event of a breach, NTM may take unilateral action at its sole discretion, which may include:

Immediate removal or modification of violating content.
Temporary suspension or permanent termination of Platform access.
Pursuit of legal recourse and financial restitution for damages incurred.

8. Policy Modifications

NTM retains the right to amend, update, or revise this Policy at any time to reflect changes in legal requirements or operational practices. Revisions will be effective immediately upon publication to the Platform. Your continued use of the Platform following any modifications constitutes your formal acceptance of the updated Policy.
